Terms of Use

These Terms of Use (“Terms”) govern your use of the Calmir iOS application (“Calmir” or “the App”). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Licence

Calmir grants you a personal, non-transferable, non-exclusive, revocable licence to use the App on any Apple-branded device that you own or control, subject to the Apple Standard End User Licence Agreement (the “Apple EULA”), which is incorporated into these Terms by reference. Where the Apple EULA and these Terms conflict, the Apple EULA controls.

2. Subscriptions

Calmir offers an optional auto-renewing subscription called Calmir Plus. The current pricing, free-trial duration, and renewal period are displayed inside the app prior to purchase.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • The subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the price last shown.
  • You may manage or cancel your subscription at any time in the iPhone Settings app under Apple ID ▸ Subscriptions.
  • Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

3. Acceptable use

You agree not to (a) reverse-engineer, decompile, or otherwise attempt to extract the source code of the App except where permitted by applicable law; (b) modify, adapt, or create derivative works of the App; (c) use the App for any unlawful purpose; or (d) interfere with the App’s normal operation.

4. Not a medical device

Calmir is not a medical device. It is a wellness and reflection tool. Calmir is not intended to diagnose, treat, cure, or prevent any disease or condition, including any mental-health condition. If you are experiencing emotional distress, anxiety, depression, or any acute mental health crisis, please seek help from a licensed professional or contact your local emergency services.

5. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

6. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Calmir or its developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the App. Our total aggregate liability for any claim shall not exceed the amount you paid for the App and any subscription during the twelve (12) months preceding the claim.

7. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will publish the updated version here and surface a notice in the App on your next launch. Your continued use of the App after the updated Terms take effect constitutes acceptance.

8. Termination

These Terms remain in effect until terminated by you or by us. You may terminate at any time by uninstalling the App. We may terminate or suspend your licence immediately if you breach these Terms.

9. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. The courts of Istanbul shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any non-waivable consumer-protection rights you may have under your local law.

10. Apple as third-party beneficiary

You acknowledge that these Terms are concluded between you and Calmir’s developer only, and not with Apple. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you. Apple is solely responsible for the App and its content only to the extent required by the Apple EULA referenced in Section 1.
